These Terms of Use ("Terms") govern your use of goembrace.co (the "Site"), operated by Go Embrace Inc., an Indiana corporation at 428 Main Street, Vincennes, Indiana 47591 ("Go Embrace," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who may use the Site
You must be at least 18 years old, or the age of majority where you live, to join the waitlist. The Site is intended for people in the United States.
2. The waitlist
Joining the waitlist is free and does not create a purchase, reservation, or order. It does not guarantee that a product will be available to you, or its price or launch date. We may change, delay, or cancel any planned product. Terms of sale, including shipping, returns, and refunds, will be published before any product is offered for sale.
3. Health information and supplement disclaimer
Content on the Site is for general information only. It is not medical advice and does not replace advice from a qualified healthcare provider. Do not ignore professional medical advice, or delay seeking it, because of something you read on the Site.
Embrace products are dietary supplements. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
Talk to your healthcare provider before using any dietary supplement, especially if you are pregnant or nursing, have a medical condition, take medication, or are sensitive to caffeine. Individual results vary.
4. Acceptable use
You agree not to:
- use the Site in a way that breaks any law or regulation;
- submit false information, or someone else's information, to the waitlist;
- try to disrupt, overload, probe, or gain unauthorized access to the Site or its systems;
- use bots, scrapers, or other automated tools to access the Site or submit forms, except for search engine indexing that follows our robots.txt file; or
- copy, frame, or misuse the Site's content or branding.
5. Intellectual property
The Site and its content, including the Embrace name, logo, design, text, and graphics, belong to Go Embrace Inc. or its licensors and are protected by intellectual property laws. We give you a limited, revocable permission to view the Site for your own, non-commercial use. We reserve all other rights.
6. Feedback
If you send us ideas or feedback, you allow us to use them without restriction or payment to you.
7. Third-party services
The Site may use or link to third-party services. We are not responsible for their content or practices, and your use of them is governed by their own terms.
8. Disclaimer of warranties
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, GO EMBRACE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, GO EMBRACE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, THAT ARISES FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME STATES DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless Go Embrace from any claims, losses, or expenses (including reasonable attorneys' fees) that arise from your breach of these Terms or your misuse of the Site.
11. Governing law and venue
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be heard only in the state or federal courts located in Knox County, Indiana, or the federal district that includes it, and you consent to those courts' jurisdiction.
12. Changes and termination
We may update these Terms at any time by posting a new version and changing the "Last updated" date. If you keep using the Site after a change, you accept the new Terms. We may suspend or end access to the Site at any time.
13. General
If any part of these Terms can't be enforced, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Go Embrace about the Site.
